Nearly eight months after the Varma family signed off on a settlement to end their dispute over the Ardee Group’s assets, the deal is still waiting for someone to actually execute it. On September 23, the Supreme Court floated a name for the job: senior advocate Uttara Babbar.

A Bench of Justice M.M. Sundresh and Justice Prasanna B. Varale proposed that Babbar act as Advocate Commissioner, assisted by the Advocate Commissioner who has already undertaken the exercise to an extent. Both sides told the Court they were agreeable to the suggestion.

“A suggestion made by this Court, as to whether Ms. Uttara Babbar, learned Senior counsel would be able to act as an Advocate Commissioner, to be assisted by the Advocate Commissioner who has already undertaken the exercise to an extent. On the said suggestion, both the learned Senior counsel appearing for the respective parties are ad idem. Thus, that leaves us to the issue pertaining to Clause 8 of the Memorandum of Settlement dated 05.02.2026," the top court recorded in its order.

The issue requiring consideration pertains to Clause 8 of the Memorandum of Settlement dated February 5, 2026. The Court asked both parties to ascertain whether Babbar would be willing to undertake the exercise before matters proceed further.

The proceedings arise from an FIR filed against Yadur Kapur by the State of Haryana, arising out of the September 22, 2025 judgment of the Punjab and Haryana High Court at Chandigarh. The dispute involves members of the family of late real estate developer Ashok Varma, including Shefali Varma and Shibani Varma Kapur, and concerns family-held business interests, real estate assets and other properties associated with the Ardee Group.

According to sources familiar with the settlement, Ardee Mall, Gopal Das Building and Vijaya Building and lands are to go to Shefali Varma, while certain land parcels are to go to Shibani Varma Kapur — a division stated based on the settlement’s terms and not recorded as a finding in the September 23 order.

The matter is listed along with the main case on October 6, 2026.
